What is a contravention and how do you apply?

On today’s podcast, our Senior Associate Dannielle Young will discuss what contraventions are and how you can apply.

When a person is not complying with an Order of the Court they are breaching the Order – this is also known to be a contravention.

The Court expects that all parties comply with the Orders of the Court. If an Order of the Court is breached then the Court takes these matters very seriously. The Federal Circuit Family Court of Australia deals with contravention swiftly and cost-effectively through the national contravention list.

You can make an application to the Court to have a contravention dealt with; this is called a contravention application. If you are the party bringing the application you bear all the responsibility to convince the Court the respondent is not only not complying with the Orders but contravened them without a reasonable excuse.

If you have reason to believe that you will not be able to apply with the order of the court you should immediately get legal advice rather than simply not complying.
