The COVID-19 vaccine is not currently approved for anyone under the age of 18. However, as discussions about the future of COVID-19 vaccines emerge, it’s important for parents to understand where they stand on this issue.

 

While we anticipate that the rollout and administration of the vaccine may lead to increased parental disputes, it’s essential to clarify the facts. At present, any threats of withholding children or imposing restrictions until they are COVID-19 vaccinated are merely speculative.

 

It’s crucial to note that the COVID-19 vaccine is not mandatory. In most cases, parents cannot reasonably withhold or threaten to withhold children just because the other parent has not been vaccinated. While there may be exceptions, the fact that one parent is not vaccinated does not automatically justify withholding children.

 

What is the COVID-19 List?

 

In April 2020, the Federal Circuit and Family Courts introduced the COVID-19 list to address matters affected by the pandemic. This list has recently expanded to encompass a broader range of circumstances, allowing applications to be made under its provisions. The COVID-19 List is a national register, and cases can be heard from any location, regardless of where the filing party resides. Hearings are conducted via phone or electronic means.

 

The COVID-19 list aims to expedite urgent matters by providing a return date within three business days or, in priority cases, within seven business days.
