Child Abduction Matters

Relocating a child out of Australia without the other parent’s consent is wrongful removal or wrongful retention. This is most likely to occur when a parent or a member of that parent’s family are from or living overseas.

The Hague Convention on the International Aspects of Child Abduction was brought into force in Australia in 1983. Only countries who are signed up to the Hague Convention are subject to the rules and at the time of writing there are 98 countries that are bound by the rules of the Hague Convention.

We have dealt with many international matters and are recognised as having experience in this field. When child abduction has or may occur, urgent legal advice and action is imperative.

These are the areas of international family law that we can assist with:

  • Separation and divorce
  • International relocation of children
  • International child abduction law
  • Hague Convention return applications
  • Overseas property law
  • Prenuptial and cohabitation agreements
  • Spousal maintenance
  • Child support, including registration, enforcement and variation of overseas maintenance liabilities
  • Child support departure prohibition orders
  • Overseas service of documents
  • Registration and enforcement of overseas judgments
  • Registration of overseas orders
